General Terms of Sale

MIVOR GbR
1. Scope
These General Terms of Sale apply to all purchases made by private customers from MIVOR GbR via our online shop.
A private customer is any natural person with residence and delivery address in the Federal Republic of Germany, whose orders cannot be attributed to their commercial or independent professional activities.
For business customers, separate contractual conditions apply, which will be agreed individually.
2. Prices and Shipping Costs
All listed prices are final prices and include statutory VAT. The price at the time of the binding order applies.
Additional shipping costs may apply, depending on the selected shipping method, weight, and size of the goods. Detailed shipping information is provided in the shopping cart.
In the event of a revocation, we bear the regular cost of return shipping and will refund the initial shipping charges as well.
For deliveries outside the EU, additional customs duties, taxes, or fees may apply, which are to be borne by the customer.
3. Payment Methods
Payment can be made via the following options:
- Direct bank transfer
- PayPal
- Visa
We reserve the right to exclude individual payment methods for certain orders.
4. Payment Default
In the event of delayed payment, MIVOR GbR reserves the right to charge default interest at a rate of 5 percentage points above the base rate published by the German Federal Bank at the time of the order. Higher damages caused by default may also be claimed, if provable.
5. Right of Retention
Customers may only exercise a right of retention if their counterclaim arises from the same contractual relationship.
6. Delivery
(1) Deliveries are made worldwide to the address specified by the customer.
(2) If force majeure (e.g., natural disasters, war, terrorism) makes delivery or service permanently impossible, MIVOR GbR is not obliged to perform. Any advance payments will be refunded immediately.
(3) We may refuse performance if it requires unreasonable effort in relation to the value of the customer’s interest in fulfilling the contract.

If the customer is not present at the delivery address at the agreed time and the goods are therefore returned to us, the customer bears the costs of the unsuccessful delivery.
7. Returns – Shipping Method
(1) Please use the original packaging for returns whenever possible.
(2) A prepaid return label is enclosed. Although its use is not mandatory, it is the most cost-effective return method. If a more expensive method is chosen without necessity, the customer may be responsible for the additional cost.
8. Retention of Title
Until full payment of all claims from the purchase contract is received, the goods remain the property of MIVOR GbR. Resale or any other disposal of the goods before full payment is not permitted.
9. Warranty (Defect Rights)
(1) In case of defects, the customer may choose between repair or replacement, both covered by MIVOR GbR. No warranty exists if the goods had the agreed characteristics at the time of risk transfer.
No warranty applies especially in cases of:
- Misuse or improper handling
- Damage from external factors (e.g., extreme temperatures, humidity, voltage surges, static electricity)
(2) Warranty does not apply if damage was caused by unauthorized third-party repairs.
(3) If the chosen type of remedy is unreasonable compared to the product’s value, the claim is limited to the alternative remedy.
(4) For repairs or replacements, the customer must return the goods to the specified address at MIVOR GbR’s expense, including the order number.
Before return:
- Remove all personal data or inserted objects.
- Make backup copies and disable passwords.
MIVOR GbR accepts no liability for loss of data or items not removed.
(5) When returning a defective product:
- If the product was used between delivery and return, MIVOR GbR may claim reasonable compensation for that use.
- The customer is not liable for deterioration due to intended use or when the defect only became apparent during use or redesign.
- No compensation is required if MIVOR GbR caused or would have caused the damage.
(6) In the event of failure to return the goods properly, the customer is liable according to statutory law.
(7) The customer may request the return of the product after repair or replacement.
10. Applicable Law
The contract is subject solely to German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Mandatory consumer protection laws in the customer’s country of residence remain unaffected.
11. Place of Jurisdiction
If the customer does not reside in Germany at the time of order or later relocates abroad, or if the place of residence is unknown at the time of filing a lawsuit, jurisdiction lies with the registered office of MIVOR GbR.
12. Dispute Resolution
In accordance with Article 14(1) ODR Regulation and § 36 VSBG:

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Final Provisions
(1) If any clause in this agreement is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
(2) Any amendments or supplements to this agreement must be made in written form.
